  • We refreshed the language throughout the policy.
  • We made the presence of visual formatting elements more accessible for screen readers or other text-to-speech solutions.
  • We updated the license that you grant us to your content, but nothing has changed about how we handle that content. To avoid any potential misunderstandings, we also added a clear commitment that we will not sell any of your AppleVis content to any third party.

Please read these AppleVis Terms of Service carefully. They contain the legal terms and conditions under which you are allowed to use, and under which AppleVis (“us,” “we,” or “AppleVis”), a division of Accessibly Inc. dba Be My Eyes (“Be My Eyes”), will provide services through www.applevis.com (our “Services”). Those Services include without limitation our website, community forums, podcasts, and the information, text, images, graphics, data, products, services, and/or other materials offered through or in connection with www.applevis.com.

These Terms of Service apply only to the Services provided through www.applevis.com. They do not govern or address in any way your use of any other Be My Eyes services or websites. You can click here to access the Terms of Service for Be My Eyes services and websites other than those provided through www.applevis.com.

Our Services are controlled and operated from the United States. If you access or use the Services from other jurisdictions, you do so at your own volition; you consent to the transfer, processing, and storage of your data to and in the United States; and you agree you are entirely responsible for compliance with all applicable United States and local laws and regulations. You may not use or access the Services if you are a resident of a country embargoed by the United States, or are a foreign person or entity blocked or denied by the United States government.

By accessing or using our Services , you agree to be bound by these Terms of Service. You must be able to legally consent to these Terms of Service in your jurisdiction to access the site or use any of our services. If you cannot legally consent to these terms or do not agree with any of them, please do not use our Services.

Permitted Users

Our services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 13. If an individual is under the age of 13, or the applicable age of digital consent if greater than 13, they should not use our services or otherwise provide us with any personal information either directly or by other means. If a child under the age of 13, or an applicable higher age of digital consent, has provided personal information to us, we encourage the child’s parent or guardian to contact us to request that we remove the personal information from our systems. If we learn that any personal information we collect has been provided by a child under the age of 13, or the applicable higher age of digital consent, we will promptly delete that personal information.

Account Security

You are solely responsible for maintaining the confidentiality and security of your account credentials, including your username, password, and any other information used to access the Service. You agree that you will not share your login information with any third party and will take all reasonable steps to prevent unauthorized access to your account.

You are fully responsible for all activities that occur under your account, whether or not authorized by you. If you believe your account has been accessed without your permission, you must notify us immediately. We are not liable for any loss or damage arising from your failure to keep your account information secure or to promptly notify us of unauthorized use.

Ownership of AppleVis IP

Notwithstanding anything to the contrary in these Terms of Service, you agree that AppleVis and our suppliers have and will retain all rights, title and interests (including, without limitation, all patent, copyright, trademark, trade secret and other intellectual property rights) in and to all of our Services, including without limitation all content created, owned, or licensed by AppleVis (“AppleVis Content”); AppleVis trademarks; and AppleVis service marks (all of that, collectively, the “Services IP”), and all copies, modifications and derivative works of the Services IP.

Content; License

The AppleVis Content is intended for your personal, non-commercial use, with the sole exception that limited portions of AppleVis Content may be reproduced in other works, including commercial works, if properly attributed in-line with the material that is used. Copying or storing any AppleVis Content for other than these uses is expressly prohibited without prior written permission from us.

Non-commercial use does not include the use of AppleVis Content without prior written consent from AppleVis in connection with providing archived or cached data sets containing AppleVis Content to another person or entity.

We own our stuff; you own yours. You retain ownership of all content you post on our site or share with us in other ways (collectively, “User Content”). But by sharing User Content with us, regardless of the method of sharing, you grant AppleVis and Be My Eyes a non-exclusive, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, publicly perform, publicly display, commercialize, and make derivative works of that User Content. You also hereby grant other AppleVis users a limited, non-exclusive license to access and use your User Content through our Services, only to the extent permitted through the normal functionality of our Services and subject to all applicable provisions of the Terms of Service.

Notwithstanding the license granted above, AppleVis and Be My Eyes agree they will not sell AppleVis User Content to any third party.

Content Moderation and Abuse

AppleVis is a shared space where everyone is welcomed and valued. To keep it that way, AppleVis may review User Content and may remove, restrict, or demote User Content that, in our sole discretion, violates our Guidelines and Rules for Posting, violates these Terms of Service, or otherwise creates a hostile, unwelcome, or abusive environment.

That said, you are solely responsible for your interaction with other users of our Services, whether online or offline. You must exercise common sense and your best judgment when interacting with others, including when you submit or post User Content or any personal or other information. You also agree that AppleVis is not responsible or liable for the conduct of any user or the User Content you create or access via our Services.

Disagreeing is OK and welcome. Being disagreeable is neither. AppleVis reserves the right, but has no obligation, to monitor or become involved in disputes between you and other users. You acknowledge and agree that AppleVis is not responsible or liable for the availability or accuracy of such websites or resources, or the content, products, or services on or available from such websites or resources. Third Party Software

We may make third-party software available through our services as a convenience to you. To use the third-party software, you must agree to the terms and conditions imposed by the third-party provider, and the agreement to use such software will be solely between you and the third-party provider. By downloading third-party software, you acknowledge and agree that the software is provided on an "AS IS" basis without warranty of any kind. In no event shall AppleVis be liable for claims or damages of any nature, whether direct or indirect, arising from or related to any third-party software downloaded through our services.

Restrictions

You must not do and agree not to do any of the following:

  • post or create any discriminatory, unlawful, infringing or hateful images, audio, text or other content via our Services;
  • solicit, collect or use the login credentials of other Service users;
  • use our Services to defame, stalk, bully, abuse, harass, threaten, impersonate or intimidate any person or entity;
  • remove, alter or conceal any copyright, trademark, service mark or other proprietary rights notices incorporated in our Services;
  • reproduce, modify, adapt, prepare derivative works based on, perform, display, publish, distribute, transmit, broadcast, sell, license, or otherwise exploit AppleVis content;
  • use the Service for any illegal or unauthorized purpose;
  • frame or link to our Services except as permitted in writing by AppleVis;
  • attempt to reverse engineer or attempt to interfere with the operation of any part of our Services unless expressly permitted by law;
  • download, reproduce, duplicate, copy, sell, resell, use or otherwise exploit any of our Services for any commercial purpose without express written permission from AppleVis;
  • interfere with or disrupt our Services or servers or networks connected to our Services, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature;
  • create accounts with our Services through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper;
  • crawl, scrape, cache or otherwise access any content on our Services via automated means, except as may be the result of standard search engine protocols or with AppleVis’ express written consent;
  • attempt to restrict another user from using or enjoying our Services;
  • violate the Terms of Service;
  • encourage or facilitate violations of these Terms of Service by a third party.

Disclaimers

AppleVis Services and the Services IP are provided “as is,” as available, and without any warranties or conditions (express or implied, including the implied warranties of merchantability, accuracy, fitness for a particular purpose, title and non-infringement, arising by statute or otherwise in law or from a course of dealing or usage or trade).

AppleVis does not warrant that Services will be uninterrupted or error-free. You agree not to rely on the Services, or any information in the Services, or their continuation.

AppleVis is not responsible for User Content. We specifically disclaim all and make no representations or warranties, of any kind, either express or implied, regarding the quality, identity or reliability of any User Content or third party services, or as to the accuracy, completeness or usefulness of any content accessible via the Services. We further specifically disclaim any responsibility or liability to any person or entity for any loss, damage, injury, claim, or liability of any kind or character based upon or resulting from any User Content.

Some states and jurisdictions may not allow for all the foregoing limitations on implied warranties, so to that extent, if any, some or all of the above limitations may not apply to you.

Limitation of Liability

In the event of a dispute between you and AppleVis or our third party service providers, and subject to the exceptions below: (i) neither you, nor AppleVis or our affiliates, our licensors or our third-party service providers, will be liable for any special, indirect, consequential, incidental or punitive damages, including but not limited to, loss of profits, loss of business opportunities or loss of goodwill, even if advised of the possibility of such damages; and (ii) liability for any matter arising under or related in any way to AppleVis Services or this agreement will not exceed USD $10,000.

The limitations between you and AppleVis do not apply to you if you violate AppleVis intellectual property rights or commit any intentional act that harms another person, our Service, or our third-party supplier(s).

Some states and jurisdictions may not allow for all the foregoing exclusions and limitations of incidental or consequential damages, so to that extent, if any, some or all of these limitations and exclusions may not apply to you.

Copyright and the DMCA

AppleVis respects the intellectual property rights of others and requires that you and all our users do the same. If you believe that content or other activity taking place on our site or Services constitutes infringement of a work protected by copyright, please provide AppleVis’ DMCA administrator the written information specified below, as required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c)(2) (the “DMCA”)

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
  • A description of the copyrighted work that you claim has been infringed upon;
  • A description of where the material that you claim is infringing is located;
  • Your address, telephone number, and email-address;

General

We reserve the right to make unilateral modifications to these Terms of Service at any time, without your consent, and you agree that we may do so. We will send notice of material modifications to your email address on file with us. Please check back often for updates. Revisions will take effect when posted unless stated otherwise

This Agreement and any dispute arising from it or related to it is governed by the laws of the State of California and the United States of America without regard to their conflicts of law provisions, and without regard to the United Nations Convention on the International Sale of Goods.

You are responsible for compliance with applicable local laws where you live or access the Services. AppleVis will not be considered to have modified or waived any of our rights or remedies under these Terms of Service unless the modification or waiver is in writing and signed by an authorized representative of AppleVis. Email exchanges may not result in a waiver or modification of these Terms of Service. No delay or omission by AppleVis in exercising its rights or remedies will impair its rights or be construed as a waiver. Any single or partial exercise of a right or remedy will not preclude further exercise of any other right or remedy.

You will not transfer, assign or delegate your rights or obligations under these Terms of Service to anyone without the express written permission of AppleVis, and any attempt to do so will be null and void. AppleVis may assign these Terms of Service in its sole discretion.

The paragraph headings in these Terms of Service are included for ease of reference only and have no binding effect. These Terms of Service and all documents referenced in these Terms of Service comprise the entire agreement between you and AppleVis with respect to the use of our Services and supersede all prior agreements between the parties regarding such use as well as any conflicting or inconsistent terms in any web sites that link to or are linked from the Services. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision will not affect the validity of the remaining provisions of these Terms of Service, which will remain in full force and effect.
